1. Definitions
For the purposes of these Terms and Conditions:
"Service" or "Services" refers to immigration legal services, consultations, and related professional assistance provided by Arbor Partners.
"User," "You," or "Client" refers to individuals or entities accessing our website or engaging our immigration services.
"We," "Us," or "Our" refers to Arbor Partners, a legal practice specializing in Taiwan immigration law.
"Website" refers to all web pages, content, and functionality operated under the domain arboorpartneess.info.
"Agreement" refers to these Terms and Conditions, along with any service-specific agreements or engagement letters you enter into with Arbor Partners.
2. Acceptance of Terms
By accessing our website, submitting contact forms, or engaging our immigration services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not use our website or services.
These Terms constitute a legally binding agreement between you and Arbor Partners. Your continued use of our services following any modifications to these Terms indicates acceptance of such changes.
You must be at least 18 years of age to engage our services independently. Minors may use our services only with the involvement and consent of a parent or legal guardian.
3. Service Description
Arbor Partners provides professional legal services focused on Taiwan immigration law, including but not limited to:
Initial immigration consultations and pathway assessments, work permit and employment visa applications, residence permit applications and renewals, investment and business immigration support, family reunification applications, document preparation and translation services, government agency liaison and coordination, and strategic immigration planning.
Services are provided subject to the terms outlined in individual service agreements or engagement letters. These Terms supplement but do not replace service-specific agreements.
Service availability may vary based on current immigration regulations, your individual circumstances, and our capacity to accept new cases. We reserve the right to decline service engagement if we determine we cannot provide adequate representation or if conflicts of interest exist.
4. User Responsibilities
Accurate Information
You agree to provide accurate, complete, and truthful information when engaging our services. Misrepresentation or omission of material facts may result in immigration application denial, legal consequences, or termination of our services. You are responsible for informing us promptly of any changes to information previously provided.
Cooperation and Communication
You agree to respond promptly to our requests for information, documents, or clarification. You will attend scheduled consultations and meetings as arranged. You will review documents we prepare on your behalf and provide feedback in a timely manner. Delays caused by lack of client cooperation may extend processing timelines and are not the responsibility of Arbor Partners.
Document Provision
You are responsible for obtaining and providing original documents required for your immigration applications. You must ensure documents are authentic and legally obtained. You agree to inform us immediately if you discover any errors or issues with documents you have provided.
Compliance with Laws
You agree to comply with all applicable Taiwan immigration laws and regulations. You will not use our services for any unlawful purpose or in violation of immigration rules. You understand that maintaining legal status in Taiwan is your responsibility, and our services facilitate but do not guarantee immigration outcomes.
5. Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of Arbor Partners or our licensors and is protected by Taiwan and international intellectual property laws. Content includes but is not limited to website design, informational articles, service descriptions, and marketing materials.
You may view, download, and print website content for personal, non-commercial use only. You may not modify, reproduce, distribute, transmit, display, perform, republish, license, create derivative works from, or sell any content from our website without prior written permission from Arbor Partners.
Documents we prepare for your immigration applications remain your property. However, our templates, methodologies, and professional work product remain proprietary to Arbor Partners. You may not use our work product to provide similar services to others or for any commercial purpose beyond your personal immigration needs.
6. Payment Terms
Service Fees
Service fees are outlined in individual service agreements and vary based on the complexity of your case and services required. Fees are quoted in New Taiwan Dollars (NT$) unless otherwise specified. Payment terms, including deposit requirements and installment options, are detailed in your service agreement.
Government Fees
Government filing fees, translation costs, notarization expenses, and other third-party charges are separate from our service fees and are the client's responsibility. We provide estimates of expected government fees, but actual amounts may vary based on current regulations and exchange rates.
Payment Methods
We accept payment via bank transfer, credit card, or other methods specified in your service agreement. Invoices are provided for all payments received. Payment is due according to the schedule outlined in your service agreement.
Refund Policy
Service fees for completed work are non-refundable. If you terminate services before completion, refunds are provided for unearned fees according to the refund schedule in your service agreement. Deposits paid to government agencies or third-party service providers are non-refundable regardless of case outcome.
7. Professional Relationship and Limitations
Engagement of our services creates an attorney-client relationship subject to professional legal ethics and confidentiality obligations. This relationship is governed by Taiwan legal professional standards and regulations.
Scope of Representation
Our representation is limited to the specific immigration matters outlined in your service agreement. Unless explicitly agreed otherwise, we do not provide general legal advice, tax consultation, business law services, or non-immigration related legal representation. For matters outside our scope, we recommend seeking appropriate specialized counsel.
No Guarantee of Results
Immigration outcomes depend on government decisions beyond our control. While we work diligently to prepare strong applications, we cannot and do not guarantee approval of any immigration application. Factors affecting outcomes include changes in immigration policy, government processing capacity, individual circumstances, and regulatory interpretation.
Professional Advice Disclaimer
Information on our website is general in nature and does not constitute legal advice for your specific situation. Legal advice is provided only through formal consultation and engagement of our services. Do not rely on website content as a substitute for professional immigration consultation tailored to your circumstances.
8. Limitation of Liability
To the maximum extent permitted by Taiwan law, Arbor Partners shall not be liable for any indirect, incidental, consequential, or punitive damages arising from or relating to our services, including but not limited to loss of immigration status, lost opportunities, business interruption, or travel delays.
Our total liability for any claims related to our services is limited to the amount of fees you paid for the specific services giving rise to the claim. This limitation applies regardless of whether claims are based on contract, negligence, strict liability, or other legal theories.
We are not responsible for delays or failures in service delivery caused by factors beyond our reasonable control, including but not limited to government agency delays, changes in immigration regulations, technical failures, natural disasters, or client failure to provide required information or documents.
9. Indemnification
You agree to indemnify, defend, and hold harmless Arbor Partners, our attorneys, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of our services, violation of these Terms, provision of false or misleading information, or violation of any applicable laws or regulations. This indemnification survives termination of our professional relationship.
10. Termination
Client Termination
You may terminate our services at any time by providing written notice. Termination does not relieve you of payment obligations for services already rendered. Refunds for unearned fees are provided according to the refund policy in your service agreement.
Arbor Partners Termination
We reserve the right to terminate our representation if you fail to pay fees when due, provide false or misleading information, fail to cooperate or communicate adequately, request services that violate professional ethics, or for any reason permitted under Taiwan legal professional rules. We will provide reasonable notice before termination unless immediate termination is necessary to comply with professional obligations.
Effects of Termination
Upon termination, we will provide you with copies of documents in our possession related to your matter. You remain responsible for any outstanding fees. We are relieved of further obligations under our service agreement except as required by professional regulations.
11. Dispute Resolution
Governing Law
These Terms are governed by the laws of Taiwan. Any disputes arising from or relating to these Terms or our services shall be resolved under Taiwan law.
Jurisdiction
You agree that Taiwan courts have exclusive jurisdiction over any disputes arising from these Terms or our services. Venue for any legal proceedings shall be in Taipei City, Taiwan.
Informal Resolution
Before initiating formal legal proceedings, you agree to contact us to attempt informal resolution of any disputes. Many concerns can be addressed through direct communication, and we are committed to resolving issues satisfactorily whenever possible.
12. General Provisions
Entire Agreement
These Terms, together with any service-specific agreements you enter into with us, constitute the entire agreement between you and Arbor Partners regarding our services. These Terms supersede any prior agreements or understandings, whether written or oral.
Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future. Any waiver must be in writing and signed by an authorized representative of Arbor Partners.
Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to a successor entity in connection with a merger, acquisition, or sale of assets.
Notice
Notices required under these Terms must be in writing and delivered via email to the contact address you provided or to [email protected] for notices to us. Notices are deemed received on the date sent if sent via email, or three business days after mailing if sent via postal service.
13. Changes to Terms
We reserve the right to modify these Terms at any time to reflect changes in our services, legal requirements, or business practices. When we make significant changes, we will notify you by posting the updated Terms on our website with a new "Last Updated" date and, for current clients, via email.
Your continued use of our services after changes become effective constitutes acceptance of the modified Terms. If you do not agree with changes, you should discontinue use of our services and may terminate any ongoing service agreements according to the termination provisions outlined above.
